Terms of Service

These terms govern your use of Notchit - the Chrome extension, the embedded website widget, the WordPress plugin, and the app.notchit.io dashboard (together, the “Service”). By installing, embedding, or using the Service you agree to these terms. If you do not agree, do not use the Service.

The Service

Notchit is a visual website-feedback tool: it lets you and your collaborators pin comments directly on live web pages and manage that feedback from a dashboard. We may add, change, or remove features over time.

Accounts

Some features require an account. You are responsible for the activity under your account and for keeping your credentials and any project keys (including your project public key and widget signing secret) secure. Do not share your widget signing secret publicly or place it in client-side code - it is used to sign verified visitor identities and must stay server-side.

Acceptable use

You agree not to:

  • use the Service to store or transmit unlawful, infringing, or malicious content;
  • attempt to break, overload, probe, or circumvent the Service’s security or rate limits;
  • access data belonging to projects you are not authorized to access;
  • resell or provide the Service to third parties except as needed to collect feedback on sites you operate or are engaged to work on.

Your content and feedback data

You retain ownership of the comments, attachments, and other content you submit through the Service. You grant us the limited rights needed to host, process, and display that content to the people you share a project with, and to operate the Service. Our handling of personal data is described in our Privacy Policy, which forms part of these terms.

WordPress plugin and verified identity

If you install the Notchit WordPress plugin and enable verified identity, the plugin sends data about your logged-in WordPress users (display name, email, role, user ID, and the current page context) to the Service so they can leave attributed feedback without a separate sign-in. You are responsible for disclosing this to your users and for having a lawful basis to do so. No data is sent for logged-out visitors.

Third-party services

The Service runs on third-party infrastructure (including hosting and database providers) and may integrate with tools you connect (such as Linear or Trello). Your use of those integrations is also subject to their terms.

Fees

Paid plans, where offered, are billed as described at the time of purchase. Free tiers are provided as-is and may have usage limits. We may change pricing on a going-forward basis with notice.

Availability and warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, Notchit and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the three months before the claim.

Termination

You may stop using the Service at any time. We may suspend or terminate access that violates these terms or that we reasonably believe is harmful to the Service or other users.

Governing law

These terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Jaffa will have exclusive jurisdiction, without regard to conflict-of-laws rules.

Changes

We may update these terms from time to time. Material changes will be reflected by the “Last updated” date above; continued use after a change means you accept the updated terms.
